CONDITIONS OF PARTICIPATION AND DATA PROTECTION INFORMATION/ TEILNAHMEBEDINGUNGEN UND DATENSCHUTZHINWEISE
1 GENERAL/ GEGENSTAND
These conditions of participation and data protection information govern participation in the “GameChanger 2.0 Special Edition Pinarello Q36.5 Tour de France 2026” Competition (“Competition”) and the collection and processing of the data collected or provided by the participants.
The organizer of the Competition is ABUS August Bremicker Söhne KG, Altenhofer Weg 25, 58300 Wetter (hereinafter “ABUS”). Participation in the Competition is free of charge and independent of the purchase of a product from ABUS. Costs may be incurred by third parties for the transmission of participant data, e.g. costs for the data connection. The Competition is in no way connected to Meta Platforms Ireland Limited as the operator of Instagram and its affiliated companies and is in no way sponsored, supported or organized by it and its affiliated companies. The recipient of the information provided by the participant is exclusively ABUS. Any questions, comments or complaints about the Competition should be directed exclusively to ABUS.
Diese Teilnahmebedingungen und Datenschutzhinweise regeln die Teilnahme an dem „GameChanger 2.0 Special Edition Pinarello Q36.5 Tour de France 2026“ Gewinnspiel (Gewinnspiel) sowie die Erhebung und Verarbeitung der von den Teilnehmern erhobenen oder mitgeteilten Daten.
Veranstalterin des Gewinnspiels ist die ABUS August Bremicker Söhne KG, Altenhofer Weg 25, 58300 Wetter (nachfolgend „ABUS“). Die Teilnahme am Gewinnspiel ist grundsätzlich kostenlos und unabhängig vom Erwerb eines Produktes von ABUS. Es können Kosten bei Dritten für die Übermittlung der Teilnehmerdaten entstehen, z. B. Kosten für die Datenverbindung. Das Gewinnspiel steht in keiner Verbindung zu Meta Platforms Ireland Limited als Betreiberin von Instagram und mit ihr verbundenen Unternehmen und wird in keiner Weise von ihr und mit ihr verbundenen Unternehmen gesponsert, unterstützt oder organisiert. Der Empfänger der bereitgestellten Informationen des Gewinnspielteilnehmers ist ausschließlich ABUS. Sämtliche Fragen, Kommentare oder Beschwerden zum Gewinnspiel sind ausschließlich an ABUS zu richten.
2 COMPETITION PROCEDURE/ GEWINNSPIELABLAUF
The Competition begins on 17.07.2026 at 05:00pm and ends on 19.07.2026 at 11:59pm (Competition Period). To take part in the Competition, participants must follow the account @abus_cycling and @pinarello_q36.5procycling, like the post and tag their favorite your favorite Pinarello Q35. 5 Pro Cycling rider.
After the end of the Competition period, ABUS will draw one winner at random from all eligible participants. The winners will be informed of the prize by direct message from @abus_cycling on Instagram by the end of 20.07.2026. In order to be able to redeem the prize, the winner must contact us within 7 days, and provide a delivery address, otherwise they will forfeit their claim to the prize. A cash payment or transfer of the prize to another person is excluded. The prize will be sent by ABUS or a third party commissioned by ABUS by forwarding agent, parcel service or post to the postal address provided by the winner. Any additional transportation costs and customs duties shall be borne by the winner. The place of performance remains the registered office of ABUS despite the assumption of the shipping costs.
Das Gewinnspiel beginnt am 17.07.2026 um 17:00 Uhr und endet am 19.07.2026 um 23:59 Uhr (Gewinnspiellaufzeit). Um an dem Gewinnspiel teilzunehmen, muss der Teilnehmer dem Account @abus_cycling und @pinarello_q36.5procycling folgen, den Beitrag liken und seinen Lieblings Pinarello Q36.5 Pro Cycling Fahrer taggen.
Nach Ablauf der Gewinnspiellaufzeit lost ABUS unter allen teilnahmeberechtigten Teilnehmern nach dem Zufallsprinzip fünf Gewinner aus. Die Gewinner werden bis zum Ablauf des 20.07.2026 per Direct Message von @abus_cycling auf Instagram über den Gewinn informiert. Um den Gewinn einlösen zu können, ist eine Rückmeldung des Gewinners unter Angabe einer Lieferadresse innerhalb von einer Woche erforderlich, ansonsten verfällt der Anspruch auf den Gewinn. Eine Barauszahlung oder Übertragung des Gewinns auf eine andere Person ist ausgeschlossen. Der Gewinn wird von ABUS oder einem von ABUS beauftragten Dritten per Spedition, Paketdienst oder Post an die vom Gewinner angegebene Postadresse versendet. Darüber hinaus anfallende Transportkosten und Zölle hat der Gewinner zu tragen. Ungeachtet dessen bleibt der Leistungsort der Sitz von ABUS.
3 PRIZES/ PREISE
ABUS will raffle off 1 race- worn GameChanger 2.0 Special Edition Pinarello Q36.5 Tour de France 2026 among the participants. ABUS is entitled to exchange the announced prize at any time and replace it with other equivalent prizes. In these cases, the winners are not entitled to any claims against ABUS or affiliated companies.
Unter den Teilnehmern verlost ABUS 1 getragenen GameChanger 2.0 Special Edition Pinarello Q36.5 Tour de France 2026. ABUS ist berechtigt, den angekündigten Preis jederzeit auszutauschen und durch einen anderen gleichwertigen Gewinn oder Preis zu ersetzen. Dem Gewinner stehen in diesen Fällen keinerlei Ansprüche gegen ABUS oder verbundene Unternehmen zu.
4 ELIGIBILITY FOR PARTICIPATION/ TEILNAHMEBERECHTIGUNG
All natural persons in their own name who reside in the European Economic Area are eligible to participate. The minimum age for participation in the Competition is 18 years. Employees of ABUS or of companies affiliated with ABUS and their family members are excluded from participation. This regulation also applies to freelance and permanent employees of companies and agencies who are involved in the planning, organisation and execution of the Competition. There is no entitlement to participate in the Competition. ABUS may reject data records/submissions without giving reasons and reserves the right to exclude from the Competition any participant who breaches these terms and conditions. Participants who attempt to disrupt or manipulate the course of the Competition or gain an advantage through the use of unauthorised aids may also be excluded from participation. Multiple participation is not possible. In order to participate in the prize draw, the participant must provide his personal contact details completely, truthfully and with acceptance of the conditions of participation. Failure to do so may result in exclusion.
Teilnahmeberechtigt sind alle natürlichen Personen in ihrem eigenen Namen, die volljährig sind und ihren Wohnsitz im Europäischen Wirtschaftsraum haben. Mitarbeiter von ABUS oder von mit ABUS verbundenen Unternehmen sowie deren Familienangehörige sind von der Teilnahme ausgeschlossen. Diese Regelung betrifft auch freie und feste Mitarbeiter von Unternehmen und Agenturen, welche in Planung, Organisation und Abwicklung des Gewinnspiels eingebunden sind. Es besteht kein Anspruch auf Teilnahme am Gewinnspiel. ABUS kann ohne Angabe von Gründen Datensätze/Einreichungen ablehnen und behält sich das Recht vor, Teilnehmer vom Gewinnspiel auszuschließen, die gegen diese Teilnahmebedingungen verstoßen. Teilnehmer, die versuchen, den Gewinnspielverlauf zu stören oder zu manipulieren oder sich durch die Verwendung unerlaubter Hilfsmittel einen Vorteil zu verschaffen, können ebenfalls von der Teilnahme ausgeschlossen werden. Die Mehrfachteilnahme ist nicht möglich. Zur Teilnahme an der Verlosung muss der Teilnehmer seine persönlichen Kontaktdaten vollständig, wahrheitsgemäß und unter Anerkennung der Teilnahmebedingungen angeben. Anderenfalls kann ein Ausschluss erfolgen.
5 LIABILITY/ HAFTUNG
Claims for damages against ABUS in connection with the Competition are excluded - within the limits permitted by law - irrespective of the legal grounds, unless ABUS has intentionally or grossly negligently breached statutory obligations. The exclusion of liability does not apply to violations of the Product Liability Act or injuries to life, limb or health.
ABUS shall not be liable for damages resulting from the impairment of the availability of the website in the event of technical disruptions and force majeure events of force majeure as well as attacks by third parties against the Competition platform. Furthermore, ABUS does not guarantee that the platform will function properly on the respective participant’s computer or mobile device.
Insofar as the liability of ABUS is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents of ABUS.
Schadenersatzansprüche gegenüber ABUS, die im Zusammenhang mit dem Gewinnspiel stehen, sind – innerhalb des gesetzlich Zulässigen – unabhängig vom Rechtsgrund ausgeschlossen, es sei denn, ABUS hätte vorsätzlich oder grob fahrlässig gesetzliche Pflichten verletzt. Der Haftungsausschluss gilt nicht für Verletzungen des Produkthaftungsgesetzes oder Verletzungen von Leben, Körper oder Gesundheit.
ABUS haftet nicht für Schäden aus der Beeinträchtigung der Verfügbarkeit der Internetseite bei nicht beeinflussbaren technischen Störungen und Ereignissen höherer Gewalt sowie Angriffen Dritter gegenüber der Gewinnspielplattform. Weiterhin übernimmt ABUS keine Garantie dafür, dass die Plattform auf dem jeweiligen Teilnehmerrechner oder mobilen Endgerät ordnungsgemäß funktionsfähig ist. Soweit die Haftung von ABUS ausgeschlossen oder beschränkt ist, gilt dies auch für die persönliche Haftung von Arbeitnehmern, Vertretern und Erfüllungsgehilfen von ABUS.
6 CANCELLATION OF THE COMPETITION/ GEWÄHRLEISTUNGSAUSSCHLUSS, GEWINNSPIELABBRUCH
ABUS points out that the availability and function of the Competition cannot be guaranteed. The Competition may be terminated or removed due to external circumstances or constraints, without this giving rise to any claims by participants against ABUS.
ABUS reserves the right to cancel or terminate the Competition without prior notice and without giving reasons. ABUS will make use of this option in particular if proper execution cannot be guaranteed for legal reasons.
ABUS weist darauf hin, dass die Verfügbarkeit und Funktion des Gewinnspiels nicht gewährleistet werden können. Das Gewinnspiel kann aufgrund von äußeren Umständen oder Zwängen beendet oder entfernt werden, ohne dass hieraus Ansprüche der Teilnehmer gegenüber ABUS entstehen.
ABUS behält sich vor, das Gewinnspiel ohne Vorankündigung und ohne Angabe von Gründen abzubrechen oder zu beenden. Von dieser Möglichkeit macht ABUS insbesondere dann Gebrauch, wenn aus rechtlichen Gründen eine ordnungsgemäße Durchführung nicht gewährleistet werden kann.
7 DATAPROTECTION INFORMATION/ DATENSCHUTZHINWEISE
ABUS collects and processes the participants’ data for the duration of the Competition for the purpose of carrying out and processing the Competition only to the extent permitted by law or with the participants’ consent. After completion of the Competition, all data collected will be deleted in full. Beyond this, personal data will not be processed or used, and in particular will not be passed on to third parties without authorisation.
The following data is collected from participants by ABUS and is used for the design, implementation and execution of the Competition: Instagram Account of the participant. The winner is also required to provide a postal address and the first and last name.
The participant may at any time request information about the data stored about him or her and/or object to the storage and/or use of his data with effect for the future and request the deletion or blocking of his personal data here.

ABUS erhebt und verarbeitet die Daten der Teilnehmer für die Dauer des Gewinnspiels zum Zwecke der Durchführung und Abwicklung des Gewinnspiels nur soweit dies gesetzlich zulässig ist oder die Teilnehmer darin einwilligen. Nach Abschluss des Gewinnspiels werden alle erhobenen Daten vollumfänglich gelöscht. Darüber hinaus finden eine Verarbeitung und Nutzung der personenbezogenen Daten nicht statt, insbesondere werden diese auch nicht unbefugt an Dritte weitergegeben.
Folgende Daten werden von den Teilnehmern durch ABUS erhoben und dienen der Gestaltung, Durchführung und Abwicklung des Gewinnspiels: Instagram Accountname. Von dem Gewinner ist darüber hinaus für den Versand des Gewinns die Angabe der Adresse und der Vor- und Nachname notwendig.
Der Teilnehmer kann jederzeit Auskunft über die über ihn gespeicherten Daten verlangen und/oder der Speicherung und/oder Nutzung seiner Daten mit Wirkung für die Zukunft widersprechen und die Löschung bzw. Sperrung seiner personenbezogenen Daten hier verlangen.

8 FINAL PROVISIONS/ SCHLUSSBESTIMMUNGEN
If individual provisions of these conditions of participation are or become invalid, inadmissible or unenforceable, this shall not affect the validity of the conditions of participation in other respects. The conditions of participation may be changed at any time without separate notification. The law of the Federal Republic of Germany shall apply. Legal recourse is excluded.
Sollten einzelne Bestimmungen dieser Teilnahmebedingungen unwirksam, unzulässig oder undurchführbar sein oder werden, so lässt dies die Wirksamkeit der Teilnahmebedingungen im Übrigen unberührt. Die Teilnahmebedingungen können jederzeit ohne gesonderte Benachrichtigung geändert werden. Es gilt das Recht der Bundesrepublik Deutschland. Der Rechtsweg ist ausgeschlossen.
